Questions about Warranty

2 years ago I built a PC. It had a Gigabite motherboard, problem was that it was the now discontinued 1156 chipset, though it was the cheapest option at that time.

model was a Gigabite H57 USB3

the features it had and made it an above average model were:

-USB3 support
-Memory and CPU overclocking
-IDE support
-good power management options
-Software tweaking
-4 memory slots

Unfortunately few days ago motherboard fried, so I return it to the shop. It had a 3 year warranty. I work outside the city and can only come back during weekends. So my dad brought the PC back to the shop. So far so good.

then my dad rings me that the shop did not have the exact motherboard brand anymore, but they have something similar, it just has 2 memory slots.
I did not mind, 4 GB RAM were plenty for me.

When on last Friday we went back to get the PC back, I notice on the back that there are no USB3 slots. No big deal, I'll get a USB3 PCI card.

When I return home, I notice that the motherboard model is one of the worst 1156 models available.We also paid them 35 Euro for expenses :

-no USB3 slots
-no overclocking options in the BIOS. RAM is limited to 1333 Mhz instead of 1600 Mhz
-low power management (CPU fan constantly spins at max)
-no IDE support
-no PCI express card for the USB3 card.
-no software tweaking

as a result, performance of my system dropped at 2/3 when compared to previous model. Not only that, motherboard shortcircuited afterwards when I opened it and tried to see if the USB3 card would fit. they lied to us, saying that it would just have 2 memory slots and that the USB3 card would fit, when in fact it feels like comparing an Audi to a Fiat.
I used the card to another older PC we had, since it had some damaged USB slots already and no USB3 support.

We returned the system back. the more serious issue is that the model they replaced it with is much worse in the first place. It is an old Foxconn H55MXV model with bad quality all over it.

The Gigabite model was covered with warranty.
what can I do? the shop staff say they do not have any other available model that fits the CPU. Production of it ceased too.

If they do not have it, arent they supposed to replace it with any model that has the same features as the above, preferably of the same brand? Even if it is a newer 1155 chipset? Dont they also have to replace the CPU since it wouldnt be compatible?

I bought it dearly (almost 120 Euro back in late 2010). Or shouldnt they at least return me my money, both for the Motherboard and CPU, so I can order a new one and build it myself?
My dad got angry at their antics and is determined to push it further, even through legal means. they said they'd contact their main office branch to see what they could do, but I doubt it will change anything.

I know the cheapest option for me would be to buy a good and currently cheap1156 motherboard online instead of paying them 35 Euro, but it feels like they ripped us off and cheated us, so this will not go easy.
They thought we wouldnt notice.

RMA directly to Gigabyte and most likely you will end up with a better, current model!

Try this and see if mobo is still under warranty. You might be able to get your money back for the mobo if they can get u a replacement. But u will have to get a new CPU as they are not responsible for it.

Problem is that the shop already took the motherboard.
they said they'll answer till Wednesday.

Problem is that I'll also have to change the CPU. The shop also does PC upgrades, so I am willing to pay a small upgrade fee. But not to pay for a full CPU buy.
those 1156 chipsets are out of production and the few remaining ones with the features I want, are ridiculously expensive online

I dont know if they'll consent to that too.
Actually with what they did they took advantage of Gigabite's reputation, choosing a much inferior model , instead of using the model's warranty.
I was thinking of sending an email to Gigabite too about that.

but paying for the CPU would be like having someone replacing your car's chassis, without doing the same for the engine as well. Doesnt make sense.
