That's my take on it also - Newegg sales of unlocked phones will increase.
The law is protecting the outrageous profit margins of the telcos that frame the conversation around phone acquisition as 'subsidizing' the cost by offering the phone for a 'reduced' rate with a service contract.

However, the way the conversation is being framed is a load of crap.
That "$800 phone" sells for $130 in China (800 yuan), and that's after it's been taxed thrice - once when it's exported to US/EU, again when it is re-imported back to China, and then a 3'rd time at the point of sale. The telcos are not losing money by selling them for $200, they're just greedy and want even more of your paycheck.

Anyone really understand it? The amount of misconceptions in the thread is amazing.

Anyways, factory unlocked phones are not banned. Jailbreaking/rooting is not banned. What is becoming illegal is unlocking a locked phone to work on a different network.

And this is absolute crap. I use a T-mobile smartphone on ATT because I don't want to pay ATT's ridiculous data fees. Now they're telling me I can't do that? Seems like an ATT tactic (since ATT and T-mobile are the only carriers that unlocking would apply to) to force you to buy a data plan with any smartphone.

I remember when DRM starting becoming popular, and I freaked; I told everyone on every forum I went to, that this was the beginning of what will eventually be a stripping of our basic freedom to use our hardware as we please. I was generally mocked for being paranoid. It's even worse than I anticipated, it's a loss of freedom in general; using a device in a way it's not intended (by the manfucaturer) to be used shouldn't be illegal if it's not being used in some kind of way that could be harmful to the health, safety, or general well being of someone else or their property. If I want to write software to turn my Galaxy Nexus into a basic MP3 player, I should damn well be allowed to. Where the hell does the U.S government get the authority to tell me I can't? The constitution explicitly states that the government does NOT have that kind of authority, and even goes on to say that a government which grants itself that kind of authority is corrupt and must be taken out of place.
How then, can this be happening? How then, is no one saying anything? This is NOT okay.

Who fights for the people in the United States? The only person that makes sense in the entire U.S government is Ron Paul and he's a laughing stock. Why?

I have no concerns, it will take 5 minutes in the supreme court and an amazing lawyer and this will get tossed right out. It's going to be the first guy to get hit and decide not to settle and he'll be good to go.

I mean, I rip my own DVD's and the files get put on my NAS. I then put the DVD's in a closet, not because I don't want them, but because it is simple and organized. I could purchase digital downloads of some content, but it isn't always available and I prefer a physical copy as well.

DRM is a terrible thing and leads to piracy, if you just let people rip DVDs I would be willing to bet that piracy would be reduced by a very large margin. I can legally purchase a 320kbps mp3 of a song on iTunes, but I can only use in on my iDevices, but if I was to illegally download the same thing it would be the same quality, but I could use it on any device I wanted.

Right now, I can't put songs purchased through iTunes onto my android phone. That's the problem with DRM.

This industry is very broken, as is our political system, and the DMCA has proven just how broken they are. You don't prevent piracy with punishment, you prevent piracy by making things worth buying.

These new additions only make things worse, not better. I've called AT&T before over an off-contrac phone I received from a friend who no longer needed it. They refused to unlock the device. If it wasn't for other unlocking services, I would have never been able to unlock it. I don't trust carriers, but hey, my opinion doesn't matter because I'm not where the money is. The EFF will probably jump on this though.

that is so they can make more money off you by forcing you to buy the same thing 100 times for each of your device. how else can they come out with the outrageous figures per song when they take you to court

This is why I have NEVER in my life bought a movie and will never do. I also don't buy music from artists that emerged from hollywood.

I buy music from independent artists that create good content not crap. Hollywood will die if they continue to be stupid as rocks. They don't like they idea that nobody is watching their crap anymore, at least my generation isn't.

Most people are on YouTube. It's the new TV, but much better because content is provided from people.
BTW, I haven't sat down and watched TV in at least 5 years. I also haven't went to theaters in ages. Not kidding at all.

Nobody cares what DMCA states about jailbraking gadgets. I buy an item and I do whatever I want to it. Deal with it!

Old farts with limited education in today's social changes sitting at the DMCA offices need to retire faster so that bright-minded people can replace 'em.
