My guess is that it will depend on how closely Microsoft's implementation matches theirs. There are a whole bunch of diagrams in the patent that I'm not going to take the time to comprehend, but you can bet that Microsoft's engineers and lawyers will pore over them with a fine-toothed comb.

if you ask me looks like a patent squatter /troll .. "SurfCast designs Operating System technology" they should have sued for windows using windows too
But you're right, why only MS? Why not Apple? If nothing else, At least this news will help increase the popularity of Windows 8.
