See above. The patent seems to specifically refer to a grid of square tiles that update asynchronously, i.e. the Microsoft live tile implementation. Neither Android nor iOS nor anyone else does it quite like this.

However, the patent doesn't refer to mobile systems specifically; I don't know if that would change anything.


My guess is that it will depend on how closely Microsoft's implementation matches theirs. There are a whole bunch of diagrams in the patent that I'm not going to take the time to comprehend, but you can bet that Microsoft's engineers and lawyers will pore over them with a fine-toothed comb.

Yet another example of how the patent system is so stupid. There should be a law that nullifies a patent if the company doesn't put it to widespread use in the real world within a year of issuing or something. I mean, who the hell is SurfCast and where is this oh so popular product that Microsoft is ripping off? How long will it take those clowns who call themselves politicians to realize that there is and should be a difference between blatantly ripping off one of your competitor's products and doing something that another company no one's ever heard of scribbled on a cocktail napkin 13 years ago.

Personally, I think this is great and from some of the diagrams there may well be patent infringement. This seems to have far more validity than half of Apple's lawsuits. It is definitely much more specific than saying, 'a rectangular shape with rounded corners.'

Yes the patent system is broken but there are times when in it's brokenness it may actually work, this could be one of those times.
