Well, there is a question of a law being violated. If a law is involved there has to be some governmental representation involved. You can do civil in conjunction with criminal proceedings when it comes to laws, but I just can't say you ran a stop sign and sue you...there has to be a criminal case first (which might just be a ticket you didn't dispute)
Though people have gotten sued for "Wrongful death" when there was no murder or man slaughter charges, I don't think many have won though. US law...every coin has two sides.
