I still think that no matter how you slice it, this is a major fail on behalf of the patent system. Try and argue that any average Joe Tech company could go ahead and apply for a patent like this and get it. There's just no sense in it and can only be explained by some kind of bias. Even if there was just someone down at the patent office who didn't get enough sleep the night before and was just sliding a pile of Apple patents through the "automatic approver" or whatever, it's clear that it would have never happened had they not been playing favorites.
