No CM9, not custom roms. You should return the phone.
No doubt, its a great phone. But its lacking in the software part of things.

Not really. Because if Motorola would have actually released ICS for the atrix then it would be possible, but it requires the drivers and updated kernels. They have to release the base version of their android before any custom roms could be made. They announced that they were going to release it but one week before release they cancelled it.

Well if your bootloader is unlocked you can install a recovery and install custom roms.
