I have an old sim card that is no longer activated (att also). What if, I use that first, turn data services off, and then stick my current sim in? Would that work? If not, I guess I will look for a prepaid sim? Not sure.

To disable data usage by phone you can just turn on your phone without sim and do that.

I was thinking about cutting the sim by myself at first but then I changed my mind and go to ATT store to get the micro sim. I thought they won't charge me the data fee as it happened to my old iphone 3g but I was wrong frown.gif

I cut it myself too, to micro sim.

Here's the thing, if you're contract and want to renew, you might as well get a smartphone. But most carriers forces you to get a data plan if you want a subsidized smartphone. If you get one that's unlocked, most phones allows you to connect or disconnect, thus you won't have an issue with spending data if you don't have a plan, if you disable it.

So, if I;m understanding this correctly, if I disable data, ATT won't know that I have a smartphone?

Wrong. ATT can and will add a data plan to your account per their TOS. You have a smartphone, you have a data plan.

ATT will know about your smartphone and add a data plan. A few have said they have not gotten one added, but those are few and far between.
The only way to have a Smartphone on ATT and not have a data plan is to buy a dumb gophone and use it as a pay as you go plan.

That sucks. I'd have to pay for something I'm not going to use anyway. I guess I'll be using pre-paid for either att or tmobile

Maybe not meow, but eventually the N4 will be recognized as a smartphone on ATT. The Gnex was never released as an ATT phone, but they see it as a smartphone as of some point meow.

Yes, ATT will auto add their lowest tier of data if their networks shows a smartphone.
Most international phones work alright, same as T-mo/other network, non-ATT crap.
