I wouldn't take anything I said as face value, I'm just reading into the ToS. Unless a staff member says anything about any of this, it's all speculation really.

Which I don't see possible because as it's been pointed out, maybe the deletion was a misunderstanding however as Stren said there are still 2 other rules they are breaking. If these users are proceeded to be allowed to post the reviews in more places then just OCN then maybe things will turn around. However it's the rule of content uploaded here having to stay here and only here is the hindering factor in this circumstance.

I'm just worried that if I'd post the exact same pic that I uploaded here, to another form, OCN might come along and say, NO, that's mine!

We won't do that in any reasonable circumstance.

In fact, I've been here since almost the begining (2004) and can't remember a single incident where this kind of thing has been an issue. The ToS clause is a legal protection, but not something we actively pursue or enforce.

To the original point, short answer is yes. Why? Who stand to benefit from the reviews as well? Retailers.
"Big shout out to retailer X for providing the blocks for this review."
People will naturally think of that retailer right after reading the review, potentially resulting in sales.

That is advertising. Agree or not it remains the same. Do I agree with all of the fees? No, but is it legal and understandable why they are doing this, yes.
I also used to do reviews and internal testing some time back for manus so I also understand that side of things as well.

So the reviewer should be forced to pay a fee because the retailers, not him, are benefiting from his reviews? Why should he pay then, how is it fair? I'm at a loss here, help me out.

You can't even watermark anything you post here.
You cannot post images watermarked to websites you are directly related to (advertising). Unless possibly if it's a sponsored thread.

According to ToS you are not allowed to post any content you have uploaded her to another site. (i.e. A build log for same build on 2 forums with same content)

The ToS doesn't prohibit you from watermarking your pictures.

Also look; EULAs in general are to cover the company of any frivolous lawsuits, they do not usually hold up in court in situations that would matter to you, me or any of the users here. No one will steal your pictures etc. from you and even if someone tried they wouldn't win that dispute because what you have agreed to is a legally non binding agreement.

Just to see what would happen.

I have no problem with OCN saying that THEIR COPY and ONLY THEIR COPY of my data that I upload is theirs. The copy that I upload is obviously theirs as THAT COPY is on their servers. But THAT COPY is all they own.

Also the "post it here and you can't post it there" is bs.

EDIT:
