You're reading lines of the first sale doctrine that aren't there. Think of the disc-writing as a one-time use software key. You're perfectly allowed to sell that one-time use key any time you want, before or after you use it. Once you use it, the code is worthless, but you can still sell the code. It is not illegal for you to resell your used snickers bar, just exceptionally few people will buy it....

I'll admit that there is a grey zone in the law. I don't think Sony wants to go up against the EFF and ACLU by putting a physical ID tag on DVDs when simply requiring PSN activation for each individual DVD will prevent second sales legally and permit people to play their games at a friend's house by logging in to their friend's console.

That simply is not true. Software is all LICENSED (not sold) in the same way. The medium on which you acquire the license to the software is irrelevant. The disc is arbitrary.

Most retail games activate via Steam, Origin, or Uplay these days, basically no more than a way to get games without having to download 10GB+ if you don't have good internet.

Unless you don't want to play AAA games, then by all means retail is the way to go for DRM free games ( pretty much what GOG is, low budget games with no DRM, aside from a very few like Witcher ).

its no worse then if i buy a pc game.i can only use that once.and i cannot resell it..im not mad and its just a patent..doesnt mean there going to use it..
