Legality of Owning Windows

I have a legit key for Windows 8. I scratched my disk, ran it over with my chair as I was rushing outside, and it melted in a house fire. I managed to save my computer but on the way out of the burning house my laptop hit the door citing and the HDD crashed. Insurance bought me a new HDD but I need that disk. Because I have the key, is it illegal to download a copy of Windows and use my key?

no it is not illegal to download copies of the installation disk. Microsoft usually has a download link to the disk ISO.

I'm pretty sure that the only time it is illegal is when you are using a windows activator or crack that bypasses the activation process and tricks the OS into thinking that your copy is legit. If you alreay have a key then just downloading the disc is not illegal as you are activating with a purchased key.

It is legal to download through Microsoft or an authorised partner like digital river. Downloading through torrents or other methods is not OK.
