Used 3770K sold as new?

Can you guys help? Ive taken delivery today of what was sold by one of the UK largest online enthusiast stores as an OEM 3770K. It came at a good discount over retail so I went for it. On delivery this morning my concerns were elevated. The CPU was delivered sandwiched between 2 sheets of foam in a small cardboard box. I've bought OEM CPUs before and they've never been packaged like this.

Examining the CPU I see a couple of little nicks in the top right of the IHS and also a pressure line on the left and right of the location of the die. I'm now thinking that this processor has been previously bought and returned to the store which they've then sold to me as new. Please take a look at the photo below and let me know your thoughts. I've got a core 2 due which doesn't have these marks and a 2600K which does but the marks only appeared after it was installed. The plastic case it sits in now belonged to one of my old CPU's and I've put the 3770K in that for the time being.

This is now the 3rd item in a row I've bought from this place which I've been suspect of. My FT03 turned up full of dust and the paint was scratched off the bottom but I let it go. Please let me know what you guys think as if its looking like a returned chip its going back with prejudice. Thanks

Its possible. Microcenter has been accused of doing this but it wouldnt sway me away from buying from them.

If you have any doubts just call them and ask. I wouldnt be comfortable with a crease in the IHS whether it was new or used.

I'd return it

All CPU's are rigorously tested from the factory so technically they are all used tongue.gif

if it works no problems (no memory channel issues, no heat issues, no serious problem) just keep it, I reckon..

Which seller was it?

I'm almost wiling not to test it and go buy a retail one from a local store - the stepping B bit has put me off a bit now too. For the record it was a store in the UK which has a URL very similar to this site. I reserve naming them directly.

Thanks for the feedback - I was willing to think that was what it was but there are 2 little dinks in the IHS which I cant get to show up on camera and they are what going me going more than anything else. I'm not in any hurry to get this in as my loop is in bits for cleaning and the case needs a couple of adjustments before it all gets put back together - normally it would have been straight in no and would have just moped about if anything wasn't right.
