That analogy isn't appropriate. Bad gas mileage would be like a game being only 6 hours long or not having enough weapons. Server problems (i.e. not being able to play the game as it is supposed to be played) would be analogous to your car not working.

If the game didn't work for people, and they wanted a refund, EA should have refunded them. Amazon did.

I think the biggest issue, and the cause of the scramble to get refunds, stems from the realization of everyone's fears when it comes to always-on DRM. It would be different if just multiplayer was down.

I agree, if the company actually inserts into their licensing agreements that they blatantly dont do refunds...that right their should tell you that the company is HORRIBLE!
( i would have used another word but i really like keeping my pms to a minimum)
