Can't assign letter to my drive

After having to deal with overlapping partitions after a botched linux install, I have various problems on my drive. First, I can no longer identify which format it is in and I can't access the drive. I can't assign letters to it since disk management says its out of date and needs to be refreshed. I tried that to no avail and this message apparently did not show up for the other partitions (I'm trying to access my 385gb partition in disk 2). I tried 3 partition wizards and they all show contrasting results so I need help.

Formatting the disk and reattempting the drive letter assignment is no option?

Well considering that I have lots of data in there and I can't back it up due to my inability to access it, I'm trying to find another solution.
