It explain how YouTube partnership and Copyright works. YouTube does not explicitly ask you to get permission. Since their ToS clearly say you can't upload Copyright material.
You should be glad Nexon didn't ask youtube to remove your video, or worst case sue you.

I started reading up on this and things have definitely changed since I was offered the partnership (I didn't actually become partnered, I was losing interest in making videos when I was offered). That policy is incredibly lame. I can see why posting clips from movies and TV as well as posting music violate copyright laws, but with let's plays and commentaries and such, the gameplay footage is yours and the game is just your canvas.

This also confuses me as to why there are still some standalone youtubers still making ad revenue off of let's plays and whatnot even though they've never had permission.

I think a legal argument could be made against this. While the framework may be copyrighted (the game being played), the actions of the person aren't copyrighted by the game company. If it was a cutscene or video from the game, I could see it; but I don't see how a user's actions in the game are owned by a game company.


However, stupid move Nintendo. Kiss all your free advertising revenue goodbye.

Have there been any legal rulings in this area? If not, I don't see that Nintendo nor MS (who already banned any profit from advertising) have any real legal standing. They cannot easily prove harm from the ads and the gameplay footage is original -- that is, the exact choices made by the player are impossible to reproduce (which implies some level of derivative protection).

 

Japan already has abusive copyright laws in effect, the fact that Nintendo took more time than MS to abuse their corporate leverage in the US for some small profit is somewhat surprising to me.

The issue with Nintendo is they refuse to move forward with the times. They are a very stubborn company that has strong policies and guidelines. They work very well for those who are hard core fans, and those who enjoy Nintendo's original work. However, as a company that still trying to "compete" in this market section they are falling drasticly behind. This is made clear with this legal move, the Wii U, and their last 2 general of handhelds.

They are trying everything they can to stay in the market without taking a gamble, it worked for the last 15 years because the tech in the handheld range and the console race slowed down drasticly. However, if Nintendo keeps their current policies I can see them doing a large layoff in the next 2 years, closing offices within the same 2 years, and lastly pulling out of the console sector and focusing solely on the Handhelds and selling rights to 3rd party's for none Nintendo system in 5 years. I don't see them recovering from their current situation without taking a gamble with new tech..

P.S. I don't want Nintendo to fail..I'm a huge fan of everything they've done, but they are a sinking ship, and without something magical happening, that ship will keep sinking slowly.

Didnt even know people made youtube channels to show nintendo games. IMO failing company with sub-par games/consoles. They are always like 5 years behind, dont even get me started about the graphics; Nintendo was nice when i was like 10.
