I have a SweetFX tutorial video that had a clip of BFBC2 to show the before & after and they wouldn't accept it even though I had my own voice commentating over the video & was a tutorial for educational purposes.

Who claimed the content EA? or SweetFX? Cause I'v got dozens of BFBC2 videos..lol

That's suprising, they normally don't do that.

He makes all the points you made in the video.
No, he insist that the videos either belong to the video creator or company, not a combination of both.
For example he said if the Let's player provide most of the entertainment, then he should own the video.
That is retarded.
A author does not tell a book cover artist, the book cover is not the reason people buy books therefore not pay the artist and all he should get is publicity.
In this case the game company provide the graphic sound even the rule-set of the game, and somehow the video creator should be the only owner with no percent going to the creator of the game?

Also he Chess/basketball argument is also stupid. Logos are trademarks, design of the look of basketball is patent. Neither one is copyright. Different rule/ fair use apply to trademarks and patent, you are allow to show/broadcast logo and look of product, but not copyright materials.

He somehow open the video but saying this is something new, but it is not. It is not the first time people create new content based on copyright material, or have multiple party involved.
As I said before company like Machinima already sign deal with game company and video creators, in other word not even a new thing even in game industry. It seems he just don't want to split the profit.

I hope everyone that uploaded ANYTHING with Nintendo removes it and tells them to go fiddle themselves.

EDIT: its either sync problem in video that must be fixed by Devim or MS has approached them. no new info for now. then again the other video on page of another youtube colaborator is still there

EDIT2: second video with just music without Hallo warriors in costumes is still on youtube, but now devinsupertramp's page on facebook is gone ...
