Regardless of what the EULA states, it does not circumvent your 4th amendment rights, the rights to privacy etc etc etc...Not to mention the EU laws this would break, instantaneously in regards to privacy.

What the Kinect Eula ACTUALLY COVERS, is for example, if I'm playing you in a Kinect on-line game and I see your mom beat you or something else, maybe you stab your sister...They then have the right, due to the subpoena to enter THAT SPECIFIC DATA and use it for that reason...You know, after I call 911 and report it thoroughly.

It does NOT mean that it's on 24/7/365 for their viewing pleasure.

When it's engaged and you're using the Kinect -- Absolutely, they can take whatever they want but, as to you doing something obscene in front of the camera while watching a movie? Negative.

I'm also not calling it the "Evil Xbox Kinect"...So, maybe that should tell you something from the start.

Lol cant make a comment without insulting ones intelligence...good guy Masked over here.

You are correct though the current setup does not allow for 24/7/365 viewing but the new xbox Kinect does use constant sound and video.

Regardless no one regulates this stuff. Even if Microsoft doesn't use this "data" from "always on" for legal purposes they still have data on you. How do you know that's not being stored somewhere for other uses? What 3rd party verifies what they are doing is correct and 100% non intrusive or used for anything against your will like commercials or advertising or statistics.

Too many people just think these types of companies are doing things 100% right and for our betterment and that we shouldn't question companies.

Also since the new xbox has Skype....Microsoft also has a way to view chat sessions and call sessions on the pc so I am sure that will be carrying over to the xbox now as well.

Everyone just thinks everyone in this world is doing things 100% right and we shouldn't questions companies.

I apologize, I did not mean for that to insult your intelligence, I'm simply saying that your fundamental rights supersede those of the Xbox EULA and that includes your rights to privacy.

I just read the EULA again and 100% if you USE the Kinect on the Xbox, for anything, it records/covers that event 100%...However, if it's simply on and you're being indecent, these events are not monitored because they violate your rights.

The new one appears to be 24/7/365 and all I can say is that we have electrical tape for a reason.

I'm not at all saying I agree with it, what I am saying is that it's not used to simply spy on you at a whim; cause is always involved.

Okay, I agree a lot more with you now haha. Same page ftw.

Im hoping I can just get a stand that will hold a photograph in front of the camera and it will take that as sufficient.lol

But it is clear that the data it collect IS being stored somewhere which I do not like. Doesn't matter what it is. I should atleast have the choice to decline that feature. I was totally going to buy the xbox one but now that Kinect is a requirement I will be sticking to my PC+3DS combo.

In other news Xbox One threads have also spurred alcohol related purchases.

This thing just keep getting better. I wonder if it is because the people managing the project were still thinking that people will accept what they give them without researching. I think the market has changed since the 360 launched. Now I'd bet the majority of Xbox One potential customers are on twiter and other social site near constantly. The tiniest rumor will spread like wild fire now and people can and will react to it.

What is left to be seen is if they will not follow through with their complaints and concerns and just buy it any way.

If the xbox 360 still have the games and still supports the experience why even upgrade to the Xbox one? They always continue to makes games even after the new gen consoles are out. If the Xbox one makes the xbox 360 experience too complicated people wont buy it and just continue buying Xbox 360s like they always are.

The new Xbox will require an Internet connection you say? Well it just so happens that I have one, looks like I'm set. thumb.gif

It doesn't bother you at all that something you're purchasing will have to connect with Microsoft's servers every 24 hours in order to continue functioning?

It's been said many times before, but I'll say it again: single-player games don't require an internet connection. Not everyone plays online. Microsoft only added this always-online "functionality" to spy on you, essentially.

I guess MS wouldn't mind loose that audience to Sony. After all, they wouldn't even pay for Xbox Live, and probably trade their games. Some of them may even pirate the console when it's possible.

People are gonna go for the Wii U, because regardless of how you feel about Nintendo, they legitimately try to make everyone happy. Microsoft knows they're invincible, so they don't even care anymore.

Lol, people will buy the Wii U... That was funny.
And MS will use the Kinect to spy on people? (although Google would?) Come on, are you wearing a tin foil hat?

My phone is always connected. Isn't yours? You don't have a problem with that do you?
