This can go further than a handshake. This could go as far as pairing unique disc identifiers to other console IDs, so that no console but your own can play that game. Probably done in the same fashion Steam works, where a registry (clientregistry.blob) keeps track of the games per account. That way you can play off line, in the event this registry gets corrupt (happens) you go online to re-establish your list.

The only bypass I see happening for this is if you play on a console that has never been online. People could very easily get two consoles, one to play games they may sell and one to play games they won't ever sell. That way, if their is ever a handshake, the servers never see it. Granted, that works with SP games only and if they allow an offline mode for those games. Which is a pretty huge IF.

The only other thing I see happening is that mod chips eventually out the use of this feature. I'm not going to promote that for piracy but you might see mod chips circumvent the used sales protection. So maybe a friend can borrow a game and try it out, stuff like that. I expect this gen to get chipped too, expect it within 5 years.
