Patent system is still a mess and getting worse, nothing new here, and nothing to be done about it.

no.

You can do something. Don't give your money to the people who are destroying it.

They're definitely not the lesser of two evils. I view them as being on the same level.

I guess the best analogy for this forum is: Apple/Samsung legal server is DDOSing the patent database.

Common misconception.

An individual, in the legal sense is a "natural person" IE, you or I, a human being.

Corporate Personhood means corporations have some rights similar to individuals, not all.
Quote:
Corporate personhood is the legal concept that a corporation may be recognized as an individual in the eyes of the law. This doctrine forms the basis for legal recognition that corporations, as groups of people, may hold and exercise certain rights under the common law and the U.S. Constitution. For example, corporations may contract with other parties and sue or be sued in court in the same way as natural persons or unincorporated associations of persons. The doctrine does not hold that corporations are "people" in the most common usage of the word, nor does it grant to corporations all of the rights of citizens.

Well how come employees can go to jail for jeopardizing the well-being of said corporation then?

edit: should clarify that I don't deny what you were saying in the original post I quoted. Just attempting to demonstrate the vulnerabilities which have been exploited in legal conflicts which have led us to this point.

I understand this but it makes it hard to discuss various different important lawsuits like this one. If it gets overturned then this could be important. I believe lawsuits like the one above both limit and expand on what might be possible in the future. All the fanboyism out of this I'd consider it important to handle them separately.

So for a instance:
Samsung vs Apple get their own thread with any real results being posted as news.
Microsoft and Motorola get their own thread separate from the samsung vs apple ones.

Otherwise it will next to impossible to actually discuss these things.

I used to avoid Apple like the plague. Now I avoid Apple and Samsung like the plague. One overcharges for lesser equipment. The other uses ridiculous amounts of cheapo plastic. If my work didn't require me to push them, I wouldn't recommend them to anybody but the idiots that already use them.

Samsung doesn't use cheapo plastic. The plastic that is used in these devices work as great if not better than the other devices I had and I've seen that weren't plastic. The cost that Samsung sells their devices at is still much higher than it cost to produce them. Just like Apple, if they set the price at a certain height and we continue to pay it then we give them no reason to lower this price.

Out of all the bad things one could say about those two companies that I'd agree with you picked out some of the few that I actually don't see as a problem. Don't want a device made of plastic? Buy something else but know that the plastic doesn't make it cheap. Find apple devices too expensive? Fine, they have a much higher retaliative cost unlocked compared to other similar devices but I wouldn't call it over priced since people are buying them.

I'm loving how easy it is to bait people into revealing their alliances ITT.

Companies don't draw lines in the sand if it doesn't benefit them.

They also don't care how you talk about them if they already have your money.
