7970 Warranty Problem - Any advice for someone who has never had a bad RMA experience?

Less than 2 months ago i build a PC for a mate with a MSI brand reference cooler 7970 GHz edition.

I built the PC, it sat unused for 2 weeks before i could get it to its owner. He used it for one week and the card started smoking from a point on the edge of the PCB and died. Nothing has been done to this card except for installing it, running it and then removing it from the case for testing when i got the PC back from my friend.

I took the card back to the retailer and explained what had happened. The first question i got was, was it overclocked? No, and if it was i wouldn't tell you...
Anyway last week i got a call from the retailer explaining that MSI had rejected the warranty on terms of the graphics card PCB being 'scratched' or 'cracked'.

Apparently this physical damage voids my warranty.

I have told the retailer that i am not accepting this as the card has not been put under any physical stress while in mine it's owners hands.. They are trying to sort something out with MSI but i have not heard back since friday.

What can i do in this situation? and how can i defend myself in my claim that the damage was not done by me? A card that stops working after a week of use and is literally SMOKING? And they are refusing warranty.. i still can't believe this has happened to me. I handle components carefully at all times and have never broken anything of my own nor anything for over a dozen builds for family and friends mad.gif

Personally I would bypass the retailer and deal with MSI direct. They have a section devoted to them here on the forum http://www.overclock.net/f/17992/msi. I've dealt with MSI a few times and had no problems. Good luck smile.gif
