Quote:
Microsoft (NASDAQ:MSFT) is requiring Xbox One owners to waive their legal right to a class action against the company, according to a disclaimer on the company's website. Those who buy the company's upcoming video game console, the Xbox One, enter an agreement that any future legal proceeding against Microsoft is done on a case-by-case basis.

The Xbox One's pre-order disclaimer says “Terms include binding arbitration with class action waiver to resolve disputes.” That means that if the Xbox One has a widespread issue like its predecessor's “red ring of death” (RRoD), the affected owners will have to sue Microsoft individually, rather than banding together in a class action.

Well Microsoft is really trying to avoid another RRoD disaster and if it does, doesn't put it their fault anymore.

What? Is this even legal to do in the United States? There has to be some sort of federal law against this sort of thing.

Sounds pretty legal here

According to attorney Paul A. Herman, a consumer advocacy expert who has previously worked on class suits against large corporations, binding arbitration helps companies like Microsoft avoid large claims. Should a legal situation arise with the Xbox One, consumers have to hire their own lawyer and pay for legal costs up front.

Steam is similar, in that you can't sue Valve over anything that has gone wrong to your inconvenience, assuming you've accepted their terms of service.

Good to see Microsoft is so confident in their new console jealoussmiley.gif

It's perfectly legal to insert an arbitration clause into terms of service and contracts.

Still not enough evidence for everybody how bad modern gaming stinks and we as consumers no longer have rights? You still not see the Evil in these companies even though its waved right in front of your noses? You still believe your digital purchases will be forever secure with them?

I'm not even singling out Microsoft here but the whole industry

You know, I posted in the PS forums that I actually might buy a PS3 Slim after all these years just to see what I missed out on while me being an xbox 360 only player these last 7 years, and this crap just keeps pushing me to do it and let my 360 collect dust for awhile while I wait for PS4 launch

All hell will break loose the day something happens with Steam to where games cannot be accessed...
