This. Companies can't write their own legislation in EULA. They can make things difficult for the claimants, but if the courts want to give a green light to a class action, they'll do so.

Lasted 7 months for me and probably longer, it was at that point I traded it in for an Elite. Never heard of anyone starting a fire with it, not saying it didn't happen, just never heard about it.

I'd assume that's how it works. It is only a contract, which can be broken. MS would revoke the services offered through the contract. I'd be interested to hear what a lawyer says about this. I'd bet that if it was pushed in count, the EULA would not stand. They've been thrown out before.
