You have to send the whole system in for repair.

MS's first take on a gaming system was off to a shaky start with the RROD. That's been entirely fixed and hopefully
they've learned their lesson about certain properties of materials when they're under heat.
As far as suing...do you live under a rock? Most companies have this to prevent idiots just taking them to court for the heck of it. Costly to keep those lawyers wallets filled...
It's like some people here only see the negatives in MS's policies and castrate them for it, then turn a blind eye towards the REST of the industry -_-
Just like when somebody argued that MS's policies "are subject to change" pft...look at the rest of the world
