The most civil way of twisting this is not to "burn the patent trolls," but to STARVE them by putting in place protections for businesses.

See i'm going to guess that, unfortunately, this guy will actually lose the case due to the nature and technicalities of the current patent system. Extortion is defined as "

The obtaining of property from another induced by wrongful use of actual or threatened force, violence, or fear, or under color of official right."

The keyword in this definition is "force" which implies physically damaging something or someone. A patent troll technical doesn't violate this because they aren't using physical means to extort money. Otherwise, the patent troll will just claim that all class action lawsuits are extortions as well since they use the threat or fear of the legal system to get more money.

The patent troll did nothing illegal, although on moral grounds they are very corrupt. Until we see a fundamental change in the patent system, it's unreasonable and a waste of time to claim any sort of racketeering damage from legal action. I'm sure the patent troll would also point out the irony of this situation--that the racketeering lawsuit is extortion in and of itself by using the same logic that the small business owner used.

If this isn't racketeering, nothing is. The patent troll was granted an unenforceable patent and is now trying to claim righteous indignation. The fact that they claimed racism when the inventor was contacted shows you how these idiots are nothing more than professional victims.

But i'm saying that you can't claim racketeering just because you are being sued, otherwise any time anyone is sued you can just counter it with a racketeering claim. Suing someone isn't illegal no matter how ridiculous the case is. The court should have automatically dropped the patent troll's suit to begin with and this guy shouldn't have had to pay 1 million to fight something this absurd. Should being the operative word, but of course we both know the patent system is bad.

And also anything physically threatening would be racketeering/extortion regardless of the case.
