[Verge] Apple multitouch patent upheld by US Patent and Trademark Office - Page 4

If they won a patent and did nothing with it then sued, they'd be trolling. But that's not the case.

Are you seriously asking me that? Look again at exactly what they are patenting here, as well as their previous patents. I'm all for patenting something innovative that you thought of first in order to protect your properties, but companies as of late have realized how broken the patent system is and have been abusing it judiciously. Apple, however, seems to be leading the charge in patent trolling these days, which is why they are the biggest target of people's disdain every time their name shows up next to a new patent.

The problem is that Apple likes to patent very vague and broad ideas that have already been well established in the market beforehand, then turn around and sue everyone else. They've done it several times with varying success, but they're basically trying to dissuade competitors from using sensible or standardized features. Apple has sued over rectangular phones, the calender icon being a picture of a calender, the call icon being a picture of a phone, the app icons being placed in a grid formation, and yes, the fact that if you squint at their competitor's phones from far away it kinda looks like an iPhone. Anyone who does not see how petty Apple is with their patent lawsuits is clearly a fanboi. Given their history and the vagueness of this new patent, I'm expecting the lawsuits to come rolling in any day now.

Apple, however, is not the only one to do this. Other companies have sued each other over equally petty patents, taking advantage of how stupidly broken the patent system is. The main problems are 1) People who look at the patents aren't usually very knowledgeable about the tech industry and 2) There isn't any strict statute of limitations on when one can file for a patent. Microsoft could right now go file a patent for folder icons, and if it was approved they could turn around and sue everyone who uses folder icons for any purpose. Would they win? Who could say, but the fact is at that point it's within their legal rights to try.. That is why it's considered patent trolling, filing a patent for the sole purpose of suing your competitors over products that are already on the market.

If Apple wants to patent a technology for multi-touch, fine. If they want to patent the concept, that's crap. There's a distinct difference between protecting intellectual property and trying to monopolize a broken patent system. But, they monopolize a broken tax system, too, so it's not like this is a unique behavior.

I don't believe the patent is for the concept. It appears to be for the technology behind it.
What gives you that idea? There are diagrams of the OS with descriptions of concepts in that patent. I don't see any text on capacitive multi-touch technology. I feel like you haven't been around for all the other articles on this subject.

You know I agree that is a stupid patent but to a degree Google and the Androids could have just done a middle finger to Apple and done everything in the reverse (IE the "Springboard" at the top for example) but I think the stupid consumer would have been unable to adjust because let's face it...the smarter (or more accurately more specialized) people become the less capable of other things they become. Hence why there's plenty of PhD's who can't figure out why they get viruses all the time and so on.

PS: Anyone else see the cronyism though in Apple getting it's ban on Samsung products and this patent upheld? Yeah, they "deal with the left or right, with dictators or liberators".

some of the first toutch screen technologie have been developed at CERN for control rooms , it was a separate glass pannel in front of the actual screen. like for the world wide web , thanks to the international and open statue of CERN we can all enjoy internet and touch screen without having to pay some crappy corporation or have any censoring. it s not to the american patent office to decide otherwise , bunch of cocky ignorant morons in offices.

Having just read the patent PDF... it's so vague it's not even funny. Apple has just been awarded a multi-touch patent on any smartphone. They aren't patenting code or anything that can't be written by anyone wanting to do the same job.

Good job on ruining the smartphone industry Apple.

+rep for cutting right to the heart of the problem.

Welcome to the new face of the tech industry folks. It's all about who can legally win the rights to be anti-competitive.

Apple essentially bought it's multitouch technologies.

I rest my case.
