Has little bearing the Supreme Court. The Court is where laws are changed and amended. There are plenty of historical precedents where some people are "protected" from such litigation, but they've been convicted anyway. Of course the exact opposite is also true and you're right when you say that plenty of people will get away with it.
good luck sueing on your own, they have enough money and lawyers to wear out your entire finacial position. c
class action lawsuits are by design, there for a wrong that was done to a multitude of people, they could pool resources , and be treated fairly by the judicial system.
READ the fine print, but your not going to like it.

Then they'll make a new case. We can wait and bide our time and continue to sue them over and over. These things aren't often won in a day or in one legal action.
