Take the 570 it replaced the mighty 480 so yes it would be a step up.

The 560 they sent you is in every was better then what you sent them IMHO, way less power used and much cooler even with the single fan. When products are stopped being made, all the good companies will send a replacement card that's equal or better in performance but they might not be worth or sell for as much as your initial product.
He recieved the GTX560 which is too inferior

Yes, indeed. A GTX650 Ti is nothing compared to that. I would take a 570 over a 650 ti anyday
