[Ars] Judge says EA executives committed “puffery,” not securities fraud

But US District Judge Susan Illston of San Francisco said their comments about EA and the first-person shooter game were essentially protected corporate speak.

"The Court agrees with defendants that all of the purported misstatements are inactionable statements of opinion, corporate optimism, or puffery," Illston ruled [PDF] Monday.

Judge says EA executives committed “puffery,” not securities fraud

Basically if this ruling stands, it's legal grounds for companies to get away with making any claim about their product that they feel, such as making legal those high graphics super awesome E3 demos that turn out to be crap games later (Aliens and that other game I can't remember being recent examples). If the end product doesn't match the preview, it's just corporate optimism.

That wouldn't have ever been in question for this ruling, it was about shareholders in EA, not gamers who bought BF4.

No, corporations are just "more equal" than citizens. If we don't treat them nice then they'll mistreat the citizens and they'll never save the economy by giving workers jobs....rolleyes.gif /sarcasm

uhm and?
They really sued EA just over BF4?
And shareholders... Shareholders sued the company about unfinished product and it's OK, because customers that bought unfinished product are not to be taken seriously?
But, honestly, what do they expect from company that is voted Worst in the industry?

funny thing these shareholders have no case, because in the last 12 months EA stock went from 20 to 38 lol
so no matter what EA does, in zimbabwe economics stocks always rise, even if they have no reason to

As a customer, is it possible to return BF4 before, or after activating it?

In a way. If you complain enough they will just ban you, so effectively they have taken back your key. You will not get your money back though.
