Not Sure If The CPU Is Still Good

I was doing some tweaking to see what my new FX-8350 could do. My FX-8320 in my Gigabyte 990FXA-UD5 Rev 1.x could get to 50xx GHz but as soon as it went over 51xx GHz it would BSOD. I was able to get to 5047GHz @ 1.4875, I backed it down to 4.7 to tweak another day. I started a game of COD AW and was about 4-5 minutes into it when I got a BSOD. I hit reset and the computer responded but I had a red light on the CPU LED. I hit reset again but this time I heard a faint sizzle sound ( I immediately hit the power switch on the PSU) and a strong smell of burnt electronics. I search for the smell and it seemed to come from the VRM heat sink. I have submitted a RMA with ASUS but have not tested the CPU. I'm afraid that if it's messed up, it might mess up one of my other boards.

If the motherboard FAILED and also took the CPU with it, WHO is responsible for the replacement of the CPU????

ASUS : Because the failure fried the CPU?

AMD : The CPU somehow caused the failure?

I tried the FX-8350 in my Old Gigabyte 990FXA-UD5 Rev 1.1. Using a Cooler Master Hyper 212 and a OLD ATI 2600XT with just the power supplies 24 pin and 8 pin cables connected. I used a screw driver to jump start the comp so I could see if it would POST. It was a no go. I had manually cleared the bios, but the computer would not stay running. It would start turning the fans and then shut down. If I left the jumper connected, it would cycle turning on (no beeps when it was going though POST) for 3-5 seconds, shut down, and then restart for 3-5 sec, ect, ect, ect.

Would taring down my Gigabyte 990FXA-UD7 Rev 3.x and getting a post code from the cpu help????
