Actually they have. When tressfx came out, it was only working on AMD, and AMD said it was open source, but they only released the code 3 years later.
The only way nvidia were able to make it work on their hardware, was to work with crystal dynamics (whom actually developed the tressfx code) for a couple of weeks until they found a way to make it work on nvidia hardware (there were changes to both game code and drivers in order to make it work).

The difference is that nvidia never said "open source, free to use" in the first place.

Tressfx (unlike hair works), is only active on the main character, while hair works is active on every character, animals etc.
So it is not that tressfx has better graphics/performance loss, it is just doing less work.
On witcher 3 there are settings to run the hair only on the main character, and the performance cost is just like tressfx in tomb raider

On rise of the tomb raider, crystal dynamics had to work with nvidia before the game release in order to make sure tressfx works well (after they learned from the first tomb raider). The code for tressfx is very heavy favorating AMD, and needed to be altered to be compatible with nvidia (so the hair will stop trying to fly up like it did on the original tomb raider before the big patches).

Regarding which games have tressfx, well the tomb raider games, as tressfx was developed by crystal dynamics. Since square enix own them, giving it to Eidos (who are also owned by square enix) makes sense.

Nvidia conspiracy theories and delay aside , the bigger question here is around the DX12 implementation.

If its not native / not coming with release, is the DX12 stuff just a wrapper/tacked on similar to ROTR?

Given that it was announced so long ago I was under the assumption it was DX12 from the ground up

Actually DX12 is what has been selling AMD cards for the last year.
Without it, their cards are just underpowered cards being trumped on by Nvidia.

AMD have been heavily advertising their cards as the superior choice because of async and DX12.
