That's just it, it's not only accessible by paying. You can obviously access it without paying through piracy. You're doing something else that's illegal, but not committing theft and this illegal action can only pursue by the copywrite holder.

That is the kernel of the issue here. Why do you buy videogames? I don't buy because the state decided I should pay for it. I buy because I want to finance the people responsible for the games I like. I don't need someone else to tell me what is right and wrong.

I won't argue that it is wrong to buy something you can afford, if it was recently developed. I don't care if people who can't afford to pay for a game pirate it, it doesn't make me feel like a fool. Likewise, I have nothing against abandonware, even if it's illegal. Do you have a problem with abandonware? Pirating textbooks in a poor country? Pirating research papers?

You can consider all that theft if you want. "Intellectual property" doesn't exist. It's a man made concept.

I buy video games because I put an intrinsic value on the personal gaming experience itself.

There are only two ways to put a value on something if it's tangible and supplied (limit of total goods) or a personal value derived by what you would assert yourself to put out for.

Pirating games is not legal. People here that do it know it and try to hide it. Most people here have stopped pirating long time ago. Never seen people defend pirating. It does not matter if you cant afford it. I cant afford iPhone also but that is not a right for me to have one. You cant afford games. Just play Free To Play. Sell skins and buy games. If you try hard enough you can make money.You pirates are just lazy and represent your country in a bad way.

I haven't pirated in ages. I'm not defending it, I'm just trying to stop it's skewed perception of legality. Should people be downloading a game? Depends on the person, but that's not for me to tell them. Should they know where they legally stand? Yes. Often laws are skewed by corporations to oppress a demographic.

You can access it numerous ways, what ordains it's legality is if you're pursued. If I drove to your house and stood on your lawn, you could pursue me for trespassing. However many people probably or could've walked all over your lawn without you suing them. It's illegal to trespass even if it's not posted, but it only becomes illegal if pursued.

So it's neither legal or illegal, but it is definitely illegal if pursued.

No you can not. Because you need to pay to do so. If you don't meet this requisite,there is no legal way to gain access to it.

Stepping on a lawn is not a good analogy,since you need only your body,and that is something wich we're born with.
