Facebook has been ordered to stop tracking non-Facebook users in France, or else it could be fined by the country's privacy watchdog.
Quote:
French data regulator CNIL (the Commission Nationale de l’Informatique et des Libertés) said in a statement on Monday that it had it issued its formal notice against Facebook, demanding that the multinational changes it practices in light of "several failures" to comply with France's Data Protection Act.

I know, the question was mostly rhetorical. Sad part is the only way this type of nonsense stops is if the management responsible gets jail time. Corporate citizenship doesn't work if the fines are small enough for the company to consider them a cost of doing buisness.

They are?

In most modern countries, there is legal precedent and legislation that specifically grants corporations with extra-constitutional rights.

In the US, CISA S. 2588 [113th Congress] makes it legal for corporations to collect, share with the US government, and sell the personal information of any person in any country without their consent or knowledge.

To be granted this legal immunity, corporations need only share personal information of suspected individuals with the government. That is the single criteria, but the benefits of legal immunity to privacy laws are plentiful; let alone the fact they can also receive the ambiguously termed "other benefits" by participating in this government data sharing.

Meanwhile, if the corporation shares personally identifying information of non-suspicious individuals, CISA still permits the government to use that information in "other ways." That's legalization of warrant-less, suspicious-less spying, folks.

All secret agencies will be permitted use of this information without a warrant, but they promise secret "oversight" is present, despite being outside of any requirements by law.

I don't know how most people feel, but to me this means corporations such as Facebook are above the law in most countries. It means many members of our law enforcement and agencies are above the law. I don't expect everyone to be a historian, but hopefully Animal Farm is still common literature.

Through the government of their home-country, corporations cannot be prosecuted for doing this. Banning Facebook requires a somewhat agregious act against civil rights as well, despite being well-intended.

Even in Facebook's home country, they appear to be above constitutional law, although most citizens seem to feel that new law supersedes or sufficiently evades prior law.

Also facial recognition on photos to track individuals without Facebook accounts in photos that they may be background of present in as a subject. It's really scary.
