Its was not throttling based on temp it was throttling based on power consumption. It was actually running cooler than normal. The stock fan curve usually keeps it in the low 70s under load and the fan doesnt even run below 60 or so. With this problem if I ran furmark it was in the low 60s with like 20% fan speed, but said it was at 110% power. The card will throttle itself based on power even if the temps are fine.

I don't know man, my knowledge of thermodynamics is leading me in an opposite direction to what you're outlining here.

If the software is in order and the card is clean, maybe an RMA is your final option.

Well like I said it isn't doing it anymore. Also since when this problem isn't occurring GPU-Z and other AB/Precision agree on the power consumption, but while it was happening AB/Precision were saying a factor of 2 higher it really looks like there was just a bug in the power consumption measurements. That would perfectly explain why it was saying it had an extremely high power consumption under small loads and why it would throttle itself even while running much cooler than normal.

Seems reasonable. I'm not familiar with how the GTX 970 does it's power consumption calculations, but I'd be willing to bet that that was your issue.
