[PCPer] Intel still hasn't paid AMD the 1.2 billion USD anti-trust fine - Page 9

Its just a formal punishment to give them a warning that "we are watching you".

Intel probably made a TON more money out of these sneaky deals under the table anyway, so paying the money if they lose wont mean a thing to them most likely. After all, they grew so big because they got more sales and a ton of money to dump towards a massive engineer force to make better CPUs than AMD.

The money is rightfully AMDs. They need it more than anyone

I thought intel never had to pay AMD the money, but to the European Union instead?

I never contested that the UK uses common law. Continental Europe means mainland Europe. Since the UK is an island nation it's not actually a part of that. I was also not aware that the US + UK constitute "anywhere" these days.

There's two lawsuits. There is a US one where Intel had to pay AMD, and an EU one where Intel has to pay the EU government.

The article may have mixed up the two, it's unclear if it's really AMD or the EU that hasn't been payed.

I'm guessing that Intel probably paid up to the EU and US first.

1) They can shut them out from their markets is they wished.
2) They're not in direct competition with them
3) They probably worked out a deal where they would offer a certain amount of product and never actually paid the full amount

What's AMD going to do?? Keep asking for the money in the most threatening AMD tone... biggrin.gif

Three law suits...

One by the EU in regards to anti-competitiveness (Won by the EU)

One by the US in regards to the same thing (Won by the US)

One by AMD in the US to address lost revenue in regards to the anti-competitive decision made in the lawsuit made by the US government. (Won by AMD)

AMD still has not been paid fine that was awarded by the US courts.

AMD still has not been paid fine that was awarded by the US courts.

http://quarterlyearnings.amd.com/phoenix.zhtml?c=74093&p=irol-newsArticle&ID=1377777&highlight=

In the fourth quarter of 2009, AMD reported net income attributable to AMD common stockholders of $1.178 billion, or $1.52 per share, which includes a net favorable impact of $1.238 billion, or $1.57 per share. AMD reported operating income of $1.288 billion in the quarter, including a net favorable impact of $1.224 billion. The net favorable impacts were primarily from a legal settlement with Intel Corp.

That has been paid and is reflected in AMD income statement during the quarter where it happened.

Look at AMD debt, the next quarter and you will see this is where most of the money went.

Intel agreed to pay AMD 1.25 billion dollars which makes it a done deal. No appeal or nothing. Intel gave AMD the money right away which happed when it agreed to the terms. Intel was happy to pay this amount because it was low all things considered.

This 1.2 billion which was fined by the european union, has not been paid and Intel has appealed that decision and still has not paid yet. This is the figure the article is talking about. And numerous news reports collaborate this.

In other words, pcper got it wrong, confused etc.

Quote:
"AMD's quarter marks another milestone in our transformation and underscores our growing momentum," said Dirk Meyer, AMD president and CEO. "We enter 2010 having completed the transition to a fabless business model, reached a historic antitrust settlement, and made significant progress strengthening our balance sheet
Quote:
2 In this press release, in addition to GAAP financial results, the Company has provided non-GAAP financial measures for AMD net income (loss) attributable to AMD common stockholders and operating income (loss). These non-GAAP financial measures reflect certain adjustments as presented in the tables in this press release. Management believes this non-GAAP presentation makes it easier for investors to compare current and historical period operating results by, among other things, excluding items that are not indicative of ongoing operating performance.

So the balance sheet was updated to reflect the judgement, but it says nothing about the money actually being paid. They updated the balance sheet without the payment in order to improve their quarterly report and aide their stock price at the time.
