The whole reason the FTC got involved is because WB was trying to hide the fact that it was an advertisement. Warner Brothers gave very specific instructions not to reveal that it was a sponsored video outside of one line "buried" below the title.
Pewdiepie addressed that "maybe he should have done it differently", but he doesn't tell us that hiding the relevant line was mandatory in the contract.
This whole case is about shady practices, not overtly breaking the rules, and thus far Pewdiepie has only denied that he was doing anything wrong, when the FTC ruling finds otherwise.
