As soon as the final release is out in the wild, there's no way to pull it off the internet. Anyone who wants it can just click on the first mirror or magnet link they find Googling it. Sure, it's technically "taken down"... but for all practical purposes, its not.


Nintendo is a giant corporation. They aren't out to screw these devs, they're out to aggressively protect their IP. If they REALLY wanted to kill the project, they'd nip it in the bud before the devs post the final code on the website's front page... instead, they've done nothing so far and will probably DMCA it in a few days, which is as long as they're willing to wait before risking their IP.


EDIT: And in a way, it probably gets MORE press from websites reporting on the takedown than they would with a normal release.

Pokemon is owned by The Pokemon Company whose intellectual property is shared between 3 entities/parent companies (Nintendo, Game Freak & Creatures). Nintendo has a 33% say in what is does as far as what goes on in protecting its shared property. Nintendo has a 33% rights stake in what happens with the Pokemon franchise and its subsequent businesses. Let us not talk from the position that Nintendo is the sole owner of "Pokemon"; although, it is the most recognized name. In Super Metroids case, Nintendo does not share its rights....it owns it 100% outright. Nintendo acting though the DMCA to shut down unofficial remakes of Super Metroid is not only probable but highly likely. Fortunately, for fans sake, it's like unscrupulous pics of you hitting the net. Once it's out in the wild, that's it. I just want us to talk from a reference point of giving proper credit for ownership of something instead of incomplete information.

Pokemon seems to be a series where Nintendo hasn't gone all that aggressively against fan games like this. I remember playing PokeMMO years ago and it still seems to exist just fine. There are numerous other fan games for the Pokemon series as well. This one is getting quite a bit of publicity, but maybe Nintendo will let it slide. Having this game shut down would be worse than AM2R as Uranium actually includes a significant online portion. I'm guessing Game Freak is a lot more lenient than Nintendo and it's helped to keep them alive.

Because there is nothing DMCA worthy about this project that would stand up in a court of law. This game has been produced for zero-profit. Absolutely no money was made or generated using copyrighted assets. This game will not receive a DMCA as long as the business model stays a "free fan-game."

Also, AFAIK this game was made using RPGMaker, so it is fully native to play on PC and PC only, but supposedly they are working on a release for Mac. I have been playing it (just got passed the second gym) and I am really enjoying it so far! It brings me back to the Ruby / Sapphire / Emerald days.

Looks neat, this and the Metroid game might be the first fan remakes/fan-made games I actually play asides from that Half Life Source one, can't remember the name.. Black Mesa ?

Doesn't appear to have controller support, we need to find a way to get this running via homebrew for a handheld, it would need porting too.
