got false copyright infringement notice, need advice

I got a warning of an infringement today. It seems sometime at about 3:20 AM GMT (I think 9:20 EDT?) someone on my IP address was detected downloading illegal movie via bittorrent. There is one obvious problem with this: I was not home. I left the house at oh around 7 am EDT for quick laundry, shopping and post office mail stuff. I didn't get back till about 1 PM.

My router was turned off from when I went to bed until I got back home afternoon so I know there was no leecher in my house. The likely case was: my DSL modem's IP address was changed at one time as it's not static. The reported copyright offense likely occurred before the time my DSL modem last resetted, and that MPAA only took notice at 3:20 AM GMT of the offending IP address but not the original time it downloaded or uploaded.

This is the second time I got notice in the email. The first time was over a year ago and it's the reason I turn off my router when no one's going to be home. Since I know it is not coming through my DSL, any other idea? Static internet IP address isn't cheap and generally not for home use.

Don't respond. If your connection or usage does not get affected with this, let them send as many as they want and only respond when someone comes knocking at the door. Usually if you respond, they may take as acceptance of guilt without looking into what you responded with.

Like said above just ignore it. Likely your ISP didn't even give them any of your information besides an email account. Most of those are equal to a phishing scam. And like you said it was probably because they logged the IP and then later sent their list to your ISP that forwarded the emails to the current "owner" of the IP address.

Update, first of all it was not phishing. I have a total of 5 email address connected to my ISP account and they aren't connected to each other. One is used for forums like this one, one is Paypal only, one is eBay, Amazon, and online places only, one is family stuff, and one with my real name in it for business stuff. The email address for Paypal and for online shopping are made up of random letters and numbers, something that won't show up in dictionary or random brute force guessing, only if those places were hacked and email address was not encrypted.

All 5 email boxes got the same email at the same time, all with my name not a generic "dear sir" that is usually used in pishing.

I contacted my ISP and provided the case #, they said they don't record any data usage, only IP address and I did have the exact IP address at the time of the complaint. It was suggested that the source complaint either got the date or time wrong or there was considerable time passed between the initial offense and the time the complaint noted the IP address and reported it to various ISP. AFAIK most torrent program didn't log the date and time of all IP addresses so unless MPAA used custom torrent tracker, they won't have accurate time range. Only the offender's IP addresses.

They said not to worry, it is usually hard for them to prove that one specific person had it if they didn't note the exact date and time of offense. They did suggest changing router password even though my router was off at the time of the incident.

PS can proxy be used to obfuscate the origin IP and make it appear to be from somewhere else? ie I download illegally and use witchcraft to make it look like someone inside the White House is doing the illegal deed?

Sounds like you have the perfect ISP that just brushed it off and essentially said who cares it doesn't matter. Like i said i would just brush it off but if you don't want to then you should find a lawyer.

From working for an ISP, I know that these kind of infringement notices are normal. There are a number of groups out there capturing IP addresses and then they go sending an email to the ISP detailing the activity and basically demanding money or turn over the customer info; usually they have no ties to the actual owners of the content being torrented.
What ISP would want to turn over their customers and lose income if they don't have to?

Some ISPs do go ahead and cover themselves by looking up the user who was using the IP address at the time mentioned on the email, and then forward the claim of copyright infringement... like what you received. If either the ISP or the group trying to extort money had their time stamps wrong, then it is very easy for the letter to get sent to the completely wrong person. Some ISPs do have a 3 strike sort of policy, but If you dont torrent, then you have absolutely nothing to worry about; chances of getting an accidental notice more than once should be pretty slim. If you do torrent copyrighted content, you are better to not discuss it on these forums. thumb.gif

Sometimes an ISP does receive a subpoena, and they are much more likely turn over the customer information if they have it recorded. These usually are tied to legitimate high profile cases and child porn.

Yeah not likely to see another notice unless I go and try to illegally download. I do use torrent, it's easier to get linux ISO this way and some of the distro don't have alternate means of fast download other than torrent.
