Asetek was a LITTLE guy company when they filed their patent. They certainly were not wealthy.

If you think that litigation reform would not come back to bite us in the keester then you probably should dig your tinfoil hat out of the closet. Because it's everybody's right to seek justice in the US Judicial system. Litigation reform would most certainly take that right away for most people.

I'd rather fix the FDA than worry about fixing the Patent Office. If you think that it's so easy to be granted a patent, file one. I have several ideas that I have not filed on because it's pretty difficult. rolleyes.gif

i'm not sure "award" is the right word for their case, but rather "compensation", or otherwise "reparation".

Hardly... CoolIt was using pre-LCLC CLCs in data centers for years before Asetek filed their patent. The CM Aquagate Mini came out in 2005 IIRC. Apple had also been using a cooler attached to a cold plate in their G5 PowerMacs, made by Delphi and then later Panasonic.

The patents in question are hilariously vague and basically just review 30 years of cooling practice to identify that it is in fact possible to cool a CPU with water. This really is a case of attaching two commonly manufactured things together (pump and cold plate), like a heatsink to a fan.

By this logic, Asetek may as well sue everyone who produces quick disconnects and we can finally stop all of those thieves at EK...

This is why the patent system is a joke. What can be patented needs to be clearly restricted.

No and no.

Quick disconnects have been round for a long time. Koolance took the technology to the water cooling market. If anyone has a claim in this regard it's Koolance not Asetek. That said, EVGA incorporated QD functions in their modular AIO system but EK already had those incorporated in their AIO. And Asetek sfaik, never incorporated them at all. Silly comparison doesn't change the facts.

And again, the patent system works. Asetek is not responsible for a government beauracracy that has grown fat and lazy over the years. They are in fact well within their rights to seek *ahem* compensation for every unit sold that abuses their legally filed patent. Regardless of what a few people seem to believe. I guarantee you this, if Asetek infringed upon what Apple did, Apple would be getting a multimillion dollar award for the infringement. That's fact.

It keeps coming up as a rebuttal to my stance that the technology already existed pre-Asetek. Please show the schematics to cite for this. Because honestly, I have a real difficulty accepting it as fact. Asetek started with Alienware and stepped out on their own. So if they violated anything I am sure we would've seen Apple suing the hades out of Alienware before they got incorporated with HP via Dell. We all know how lawsuit happy Apple is. doh.gif

Rest of the world doesn't agree with American judge that gave Asetek that patent.

Cooler Master Aquagate mini r80 r120 has in production in 2005. While Astek had a prototype in 2006 for Technology Showcase at the Intel Developer Forum 2006

Two of my siblings are patent attorneys and I've helped them with a lot of patent research. It's not who builds it first or who sells it first. It's who patents it first that counts.

And yes, some patents get through that shouldn't, but bad calls are a part of the game.

You do realize that this is the exact argument zero, huechler and I are making, right?

CM had a product on market before Asetek filed a patent for such a product. By your logic, it should and does not matter if Koolance came to market with quick disconnects first because Asetek (later) filed a patent for the concept.

Apple didn't own the patent - Delphi and Panasonic provided the cooling unit (I do not know if they (plural) were patented or not).

In 2000/2001 Asetek wasn't making CLCs, they were making and selling (independently of Alienware who they had no relationship with) VapoChill systems that were phase change systems. Asetek seems to argue it didn't come to market with a LCLC until 2007:

Alienware was making air cooled PCs and really proud of the fact that they were pretty colors. They didn't introduce a liquid cooled system until 2004, the ALX.
