No, but it is illegal use of another company's logo. That is clear as day illegal. This issue can cost XFX millions of dollars. Try putting an unauthorized Apple logo on some product. Count to 10 and Apple would be sending cease-and-desist orders. Try that with Disney logos or Coke logos. I maybe a "mook" but you have no understanding of the corporate world.

I know for a fact that EVGA US did not really care and most of the guys here laughed at it, BTW.

Well, EVGA screwed me over on TWO seperate rebates, both from newegg, both claiming invalid serial number , and refused to process them at all. I should have learned the first time. Then I attempted to do a step-up, they lost my card for almost a month, and then denied the step-up and said I was ineligible because it was past the three month period, because they lost my card.

I can totally understand the cease and desist and improper use of a registered logo, but they are blowing this out of proportion, and IMO this is just one more reason I will NEVER do business with EVGA again.

Did you call about those issues? They usually will work something out. Did you have tracking on your Step-Up to prove delivery date?

One was my 6800GS, one was on my 7900GT KO. They pretty much gave me the run-around and said I had to call newegg, blah, blah, blah, and then when I called newegg they said it was on EVGA's end. I got sick of the runaround, and considering that I earn a pretty good hourly wage, spending much more than an hour or two on the phone for a $30 rebate actually begins to cost me money instead of save it. I have had nothing but awful luck with rebates, and have pretty much become convinced that they are nothing but a scam, oftentimes costing more in wasted time to receive them than to just buy a product without. It seems to be standard policy for companies to automatically process rebates as invalid until you try to fight them. I will not buy ANY product with a rebate now as a personal rule.

The card was not lost by UPS, it was lost internally. It showed delivered, but they had no record in receiving. By the time they finally got my card to enter into the system, they were going to have to reapprove, etc., costing even more time. I told them to forget the step-up, and send my card back. I got it a few days later, and sold it to upgrade to a different brand.

I have heard almost nothing but good about EVGA as well so I guess I just have had bad luck

oh my, I'm a bit emberassed to have an EVGA card now, such fraility, they should have just played back instead of acting like a bunch of geeks.

If XFX doesn't supply something along the lines of "we didn't know it was there; the guy has been disciplined/fired" or "we knew it was there, it was a joke, oops", then EVGA has every right to pursue this.
