this is stupid.... it won't really have an affect on microsoft, except to make them push for this lawsuit even more....

also i don't see how Microsoft could not be a monopoly....but they can't be brought down for it because they are in direct competition with Apple who has no plans on helping microsoft anytime soon....

Even if MS doesn't have anything to do with open source or linux, if they have patents and copyrights on things that are being used by Linux "even if they did it first" then MS has the right to sue the developers. Sorry, but that's the way it works. Somebody shoulda done their homework making open source stuff and copyrighted the stuff for the community.

Let's say MS copyrighted "a menu opened by clicking a toolbar button on the desktop to open up a menu with a series of options to navigate the computer"...now I dono if that's what they have, but that would mean lots of distros of linux are guilty of breeching that. Dumb example, but there ARE copyrights and patents on things that stupid.

i am fully aware of that, however i believe that many attempts at this sort of thing have been stalled with some sort of mutual agreement (csco vs appl anyone?)

also i dont think you know what a patent is because you cannot patent a general thing; like you cannot patent RAM. lets say elixir wanted to patent ram IC's so only their **** ram would be on the market. so no one else can make ram....um ok....

so you cant patent general aspects of a UI, although you can patent the UI as a whole, itself.

Kay, now did that exist before MS invented it, on the Windows 95? No. And since that invention is something they created, they can patent it to prevent others from using it. Is Linux using that type of a clickable button that opens a menu that allows to navigate a computer? Yes, so in effect they are breaching that patent.

Both M$ and Apple based their GUIs on one from the Xerox Alto...
Perhaps you should do some research before claiming M$ invented something...
