Emulators are legal.

Game companies use them to design their games and see how it will run before making the actually cartridge/UMD/memory card to test on the actual console

well, if you dont own it then it's illegal but if you do own the game then i really dont know

Edit by Vulcan - It is illegal to download commercial ROMS whether or not you own the original cartridge.

Just because you own a CD doesn't mean you have the right to download all the MP3s from the CD off of BitTorrent, but no one will question your right to rip your own MP3s. Same thing, easy to understand.

As someone pointed out, there are legal ROMS; basically it's homebrew for the emulated console. That's perfectly fine because there's no copyright being enforced, the creator wants you to play it. But the truth is that that's not what people download, they're going after the "real" ROMs...so I always say that downloading ROMs is illegal just to make it easier.

I suppose it's possible that a comercial game ROM has been turned over as freeware, but I know of no game that has done that. It was a rare occurrence with old computer games, and it's even less likely now given the popularity of download sales through channels like the Wii Virtual Console. It's common sense, guys: they're not going to give you for free what they can still make money off of.

I'll leave the thread open for further questions if there are any, but the poll is closed.
just to expand a little on what you said these roms can be leagally downloaded if you pay for them, there are sevral legit sites that offer the rom for a price or a monthly fee, these sites are not in violation of the law and you can legally download the game, as i understand it part of there profit goes to the RIAA or MPAA or what ever AA potects ninetendo.

that doesn't mean they are not illegal. they still could own the copyright on that game even if it is that old and by having a copy that you didn't pay for is still illegal. how much money you make off it doesn't matter.

Unless you own a PS2, I believe. Just like you can download a game (as your backup copy) if you own it already.

Yep. If a company goes out of business, they are still copyrighted. The Berne Copyright Conventioon makes the copyright valid until 50 years after last creation (whenever the business when out of died or stopped producing the game.)

Still seeing some misinformation posted, so I went back and peppered a LOT of posts in this thread with the truth about downloading commercial ROMs. Don't feel like I was singling you out personally if I edited your thread, I edited a LOT of threads. The idea was to keep someone new from reading three or four posts with misinformation, then deciding to post their own opinion without reading through to the end.

Yeah, but that's typically a professional development kit you're talking about. They are created by the people that are make the hardware, and are licensed (for no small fee) to developers. Not many non-pros have legal dev kits, which is why so much of the homebrew they talk about on XBox-Scene.com isn't directly downloadable from there...it was developed with an unlicensed dev kit and uses unlicensed libraries, and is subsequently illegal.

That would be true, yes. Something like GameTap, or even the Wii Virtual Console, is certainly 100% legal because you're paying the necessary license fees. Conversations under this header rarely mean this though, 99.9% of the time it's about free and illegal downloading off a web site, P2P, torrent, etc.
