It is in the EULA, OEM and retail that if you do not agree to the terms you can return the software for full refund of the price. No, it is the same thing. You don't buy the OS from Microsoft when you buy a Dell, you buy it from Dell.
Just like when you buy a SATA HDD that comes with SATA connectors, the company most likey didn't make the cable, they probably bought that cable(in bulk) from another company and sold it with their HDDs, thusly, the same type of scenario. A product bought from one company, sold to another, packaged with something else, sold as one product. Happens all the time in the business/manufacturing world.
