Its OEM software it only will work with the original mother board it was installed on. So I cant sell it... the OEM software on Newegg is half the price of retail so its still $100 bucks i should get back

It was free. It came with the system "Included in Price". There is no money for you to get back.

If you want to waste your time, then by all means go for it.
You should have ordered a Dell with Linux already installed.
Or just built one.....

Dell help is extremely difficult to communicate with. Quickness is the furthest from their minds. I think they just want to keep you on the phone/computer as long as they can to make you just give up and accept what you have.

First mistake was going through the online chat. Those support people are not authorized to give refunds and such.

But, you WILL be able to your money back if you are willing to spend the time on hold with dell. If you ever get stuck in the "windows is free" argument again, point out that systems sold with ubuntu sell for 60 less than their windows brethren because that is how much dell pays for the license.

Think of it this way. Say you get a SATA HDD kit from Wal-Mart[groan].
When you get home you open the box and it has a SATA HDD, 1 SATA MB Cable, and One 4-pin molex to SATA PSU connector. Now, say you already have a PSU that has the SATA connector, AND you already have a SATA cable, so you just use those. Can you really go back to Wal-Mart and say, "hey I wanna refund for this SATA cable and 4-min molex to SATA adapter I didn't use when I bought this HDD kit. Not only will they have no clue what your talking about(it's wal-mart, loL!), but they will just tell you that you have to refund the whole thing or none of it. I know this is a different situation, but the idea still stands.

No, that isn't what is going on here. You have 2 entities selling you a product. Dell and Microsoft. You CAN buy just the product from Dell and return the Microsoft. It is in the EULA, OEM and retail that if you do not agree to the terms you can return the software for full refund of the price. Now the OEM from dell is going to be significantly cheaper but you can still return it.

No, it is the same thing. You don't buy the OS from Microsoft when you buy a Dell, you buy it from Dell.
Just like when you buy a SATA HDD that comes with SATA connectors, the company most likey didn't make the cable, they probably bought that cable(in bulk) from another company and sold it with their HDDs, thusly, the same type of scenario. A product bought from one company, sold to another, packaged with something else, sold as one product. Happens all the time in the business/manufacturing world.
