It used to be you could download a rom as long as you deleted it from your hdd within 24 hours...just curious.
Urban legend. There is not, and never has been, any "24 hour" rule. All of those ROM sites that say this are 100%, completely and utterly, full of :turd: .

This is true. Contrary to popular belief, owning an original copy of a game does not make it legal to download that game's ROM. Just because you own a music CD does not make it legal to download the MP3 of the songs on that CD. However, it is legal to rip your own ROMs and your own MP3s from the original media you own....with one exception and/or caveat. If that game or music CD has copy protection on it, then it is illegal to bypass that copy protection, even to make your own personal backup.

It's a stupid set of laws and we all know it, so please don't post any opinions about it. If you want to complain, complain to your congressman. But when writing here, keep the conversation legal, please.

Nice try...but in case you didn't notice, the PSP only has one screen...*****.

downloading ROMS, pirated MP3s, software, and games, modding consoles...etc.

are all illegal.

yes modding consoles is part of the agreement....you are not allowed to reverse engineer or modify the console in any way...

Legal issues

Some nations have laws prohibiting modding and accuse modders of attempting to overcome copy prevention schemes. In the United States, the DMCA has set up stiff penalties for modding. In the European Union, member states have agreed the EU Copyright Directive and are transposing it into national law. A man was convicted in the United Kingdom in July 2005 for selling a modded Xbox with built in software and games.

The fact is that the DMCA says nothing about modding specifically. What it prohibits is bypassing copy protection schemes. Clearly, mod chips do this.

However, the courts have already struck down application of the DMCA in certain contexts. The case in question involved Lexmark suing a replacement printer cartridge company; Lexmark sued them for reverse engineering the microcode on the Lexmark ink tanks to make the third-party tanks work in Lexmark printers. And they sued under the DMCA. And they lost.

And let's not forget the humorous but true story of early copy protection on a music CD. One intelligent person figured out that tracing around the edge of the CD with a felt tip marker disabled the copy protection. By the letter of the DMCA law, felt tip markers are therefore illegal.

So the tipping point of "illegal" or not depends largely on there being significant non-infringing uses of a particiular process. On an XBox, mod chips enable a whole gamut of new opportunities: bigger hard drives, replacement dashboards, XBMC media center, running linux, etc. Generally, it will be harder for a company to squash this in the courts. Contrast that with the current hacks for the X360, which have no purpose in life except to bypass the copy protections on game software. The difference is pretty clear.

As for the cited example of the guy in the UK: He got arrested for selling XBox's preloaded with something like $500 worth of illegally copied games on them. I mean, duh. If he just sold XBox's with a mod chip pre-installed, but with only the original XBox system software installed, he very well have may escaped such dire consequences. The bigger an idiot you are, the farther you fall when you're busted.
