8800 gts 320mb stock returned defective after two weeks replaced it with 8800 gts 640mb no problems.....yet?

I haven't been getting such great framerates in DX10 games, but I didn't know whether to point fingers at my CPU, bad coding, or just DX10. Now I have something else to point fingers at...
Although I haven't been getting anything as drastic as this article is describing.

Clearly you havn't owned an ATI card in well over a year, ati has had great drivers since the X1k series came out, I've never had problems with them on my old X1600Pro or my old X1800GTO
