Pirating a game to play would be like borrowing a book from a friend. Have you ever borrowed a book from a friend? Is that stealing? Cuz it sure as $%*& is the EXACT same thing as pirating a game.
How is pirating a game the same as borrowing it? Borrowing from a friend is different than intentionally downloading it illegally to play. Do your friends photo copy books and give them out? That is pirating. If your friend purchased the game and you borowed it, you are essentially sharing one product. When it gets copied (or distributed) to multiple people all from one copy, that is pirating (aka stealing)

You don't need to make a profit to steal or pirate. To use your analogy, the person supplying the DL of the game would have to uninstall it on his/her PC and only let it go to one other person. Once they take one and distribute it to multiple people, that is illegal.

edit: I should have used the term distributing in my other post. I did not mean to imply that there is a difference between stealing for use and stealing for profit.

Really? I don't follow your logic. If I borrow a book from a friend and read the story without paying the author for enjoying his ideas, how is that ANY different?

Really? I think you have some definition confusion. If I borrow a game from a friend, beat it, and return it to him... THAT is piracy! Why don't you ask M$ or Sony if "sharing one product" amongst friends is fine with them?

Actually, both are illegal. So you're saying that it would be perfectly fine for one copy of a game to circulate throughout the world as long as only one person has it at a time? I don't think so.

Look, I am not looking to start a flame war. All I wanted to do is point out that taking something that isn't yours, including services and items that are not tangible is still stealing. There does not need to be a set value on something for it to be wrong. Just because code can be reproduced multiple times at essentially no cost does not mean it is OK to do so.

As for the borrowing argument, that implies that one peron is using said item at one time. If I called MS and said I was letting you use my retail copy of XP, I am sure they wouldn't give a hoot as long as I wasn't trying to use it at the same time. The same goes for Sony. If I gave you a CD to listen to, they have no right to say otherwise as long as it isn't being copied. Same thing for a game. If I buy a game and let you play it and beat it, that is not piracy. It becomes piracy when I offer it to you while maintaining a copy as well. I agree the analogy was a poor one.

edit: I would like to see where it states that I can't give away a copyrighted piece of material if I am no longer claiming ownership of said item. Christmas would be a mess

People were bashing the Windwaker when it came out because the graphics weren't as realistic as most other games at the time, but despite the low poly and other limitations, artistically it looks 10 times better than Crysis.

Would you play this game if it had CoD4's singleplayer?

I agree. And I've said multiple times that nothing justifies piracy. I'm just trying to help you realize that borrowing a book is the same thing. You may not think of it the same way, but it is. I bet a 90 year old would easily see the comparison. And who said anything about a flame war? We can't have a productive discussion without it being labeled a flame war?

I think you're wrong here. OEM means one install, one time, one machine. Retail means the PURCHASER can install multiple times, but only on one machine at a time. I'm not saying M$ will care if you want to give your copy of XP away, but I'm pretty sure it's still illegal. Can I get a confirmation on this copyright experts? (I'm looking at you VulcanDragon)

I'm pretty sure if you buy a game, register it, play it and beat it, then give it away for a Christmas present, that's technically illegal. If not, then why won't Blizzard let people sell their WoW accounts?

No it is not the same thing. When you pirate a game, you are using a COPY. When you borrow a book, you are physically removing the single item from the original owner. If they COPIED the book, that would be closer to PC game piracy.

You are assuming I am talking about an OEM version. From here:http://www.microsoft.com/windowsxp/home/eula.mspx

Quote:
13. SOFTWARE TRANSFER. Internal. You may move the Software to a different Workstation Computer. After the transfer, you must completely remove the Software from the former Workstation Computer. Transfer to Third Party. The initial user of the Software may make a one-time permanent transfer of this EULA and Software to another end user, provided the initial user retains no copies of the Software. This transfer must include all of the Software (including all component parts, the media and printed materials, any upgrades, this EULA, and, if applicable, the Certificate of Authenticity). The transfer may not be an indirect transfer, such as a consignment. Prior to the transfer, the end user receiving the Software must agree to all the EULA terms

As far as the last part, I never said I was going to register it and play it. Besides, there are plenty of games that do not need to be registered to play.

As far as i know console Piracy goes more the PC. For most games you need a fast PC and for consoles you know it will work and u download it. Last year was the last year i ever buy a PC game other then i like. I bought GTA SA for 70$ and i tried in my PC and it dint work cause it was too slow. There goes 70$. I go to Ebgames and i sell it for 15$ and like 30 other games in total 120$ and i buy 3 Xbox games and try them and they suckkeddd. Now there goes all the money i had. Today i whent to but GOW for PSP it was 50$ and i finished the game in 6 hours. It was fun but come on same engine as other GOW for 50$. i dl many games now and gues what i all the games i Dl max time i spend is 1hour. I was going to dl CD$ but that the heck its a good game so my friend its selling it to me. Games that are worth playing that last last i would even pay double or triple the money. For example Warcraft 3 i have been playing it for 3 years non stop and no matter what other game i trie i still get back to Warcraft.

I dont know about in US but here is canada when you buy a movie technicaly only the buyers has to watch it and maybe their family memebers. if he gives it to a friend to watch i think its considered ilegal. For example if a teacher showes a movie in class they have to report to principal and say how many people watched it and have to pay to the author the cost eventhough they bought the movie.

Final thought Piracy will never end. If there was no piracy man 70% of people that use computer will not be on. They wolud probably do something else. Tell me if you buy a new computer for lest sey 1000 at best buy all u are going to do is MSM forums and get bored. Softaware and trying new stuff makes me use my PC eventhough i am not going to use them.
