Now that the game's out here's an update:

Dx 9:
Minimum FPS: 38 Max: 68 Avg: 50

Dx 10:
Minimum FPS: 23 Max: 47 Avg: 34

I have to say that ubisoft have worked on dx10 quite a bit, before when I looked at a large crowd the FPS would drop significantly, that doesn't happen anymore but the overall FPS is still very low, I could actually feel DX 10 lagging a bit whereas DX 9 was butter smooth.
In summary DX 10 hasn't shown a boost in FPS or image quality, it's shown a drop in FPS when looking exactly the same as it's DX 9 brother... not very impressive at all.

Give me a couple min to find it but at lower setting dx10 performed better. Not exactly great news but a step in the right direction -_-

I wouldnt count it unplayable or much of a difference when you getting above 60FPS. Thats mad of you to say that. Anything over 60 in any game is a gift from the GODs. That said, anything over 60fps your eyes can not tell the difference. I would go as far to say 40 is very playable and 35 in some games. Like crysis
