I don't think so, I've never seen anything like that. I think by including Overdrive in the CCC, ATI, regardless of the partners, are pretty much encouraging it.

Unless you killed a card with some ridiculous voltages I'm not sure if they'd know anyway. I've RMA'ed a few cards in my day, some of them died by my "reckless" hand as well.

I guess they know alot of the enthusiasts are gonna do it so why bother with a policy they probably cant enforce.

acually ASUS does i think, gotta check up on that though. Its only for 3 years too i think.

Actually, they do. But thats a moot point regardless, they don't make ATI cards unfortunately.

They can't really tell I guess if it was overclocked and fried. It could have fried for various other reasons or could be just defective. I would assume CCC overclocking though is covered since "unlocking it" doesn't give any indication that this will void your warranty and it only applies "safe" clocks.

Not tried it myself but AFAIK as long as the mod is reasonably un-done by the time it gets to them it's all good. they just request the card back in the same form as it shipped.
