...that is not at all a similar situation, and I suppose he could sue them for discrimination, but that case would be tossed out the window in about three seconds.

I don't think Daniel_K was at fault as Creative makes most of their money (not all) selling hardware and I just believe that he allowed the general public to use the hardware they paid for when they "couldn't" and shouldn't we get what we pay for?

I remember some seller on eBay got sued when she said on her auctions that she was selling a picture of a phone and filled in the specs of the phone on the picture. She had to refund the plaintiff + compensation + court. Humm... all because the product (pic) she was selling didn't meet the specs... Does the card do what's advertised, I think not!

So because they can't hire capable/educated programmers and because one man can do what their whole team of programmers struggle to do, Daniel_K is at fault... I don't get it... TBH, Daniel_K should either be hired, have his modified drivers source code bought, have his drivers used as the officials and paid royalty (like a salary to update his drivers if they don't wanna hire him), or send all their programmers back to school where I'm not even sure they went to in the first place. Maybe a couple etiquette classes too.

I think the biggest problem with this debate is that people think he got in trouble for taking donations, this is 100% not the case and in fact creative has said that it is OK for him to take donations. The problem was with the alchemy modding he did and nothing else. He was not taking donations for profit, he wanted to buy more creative products to make driver mods for those. He lives in brazil and a card that costs $80 here costs the equivolent of $400 over there so this is the only reason he asked for donations, all his driver downloads were for free. So for anyone to call him a theif or even assume he did anything wrong by accepting money is just plain incorrect. He was and still is allowed to take donations and creative said so.

I'm sick of hearing about that lazy moron.

Yes, we do have a serious local price regarding eletronics as well as any other thing here in Brazil (112% taxes over foreign products' value). But what does that means? That you gotta be a lot more hardworking and clever so that things can go fine and you buy everything you want.

Life isn't easy, fact. That doesn't mean you gotta ask for money due to his own lazyness that's just stupid and I'm not even talking about the donators either.

Major lazyness and stupidity. My last 2 cents.

PS: I bet he's just trying to get a new rig to play Crysis or something. *****

Ok, let's pretend that Creative's programmers get paid $25/h and all taxes don't apply.

It pretend took them 2 months to develop poop drivers. That's $7,875 for something that doesn't work.
It pretend took Daniel_K 1 month to modify them, he made $0.
If he was working for Creative, he would've made $7,875 and oh, the drivers work.

So with that crap example, it still demonstrates that he lost ~$8,000.

Now I believe that he made Creative's rep because as we can see, without him, they have none. So $146.00 for all he's done for them isn't much to ask for considering it was for his service (donation) and not even from their own pocket.
