Some people say you should stay under 1.36.
However I run mine at 1.38 daily for well over a month. I've also pushed the vcore way up to do a few suicide runs also. Like a vcore of 1.65.
Also the Xeon chip is supposed to be a little better than the E8400 so you might be good there also.
I could not guarantee you won't get the degradation though, every CPU is different. You may also want to ask that question at XtremeSystems under the E8400/E8500 thread here if you're worried.
