[TechNewsWorld] Is Psystar Onto Something?

Different take on the Psystar case in particular the EULA and whether it is legal.

http://www.technewsworld.com/story/I...ing-62655.html

Quote:
Psystar does have a precedent in its favor, a 1984 U.S. Circuit Court of Appeals decision holding that a software publisher can't require you to run an operating system on a specific type of hardware. The Supreme Court refused to review the case. (emphasis added)

I think all this hype is actually what psystar needed/wanted. If apple wouldn't have said anything I am sure they would have died by now. Any publicity is good publicity I guess.

Even if they don't sell a single computer but they win this then it'll open the doors for Mac Clones and they'll go under. Echoes of IBM in the past.

I mainly posted this as I was have been asking about EULAs, in regards to this in particular, and no one was really able to answer. So I have been looking at several sites where a EULA was deemed invalid, mainly CC companies, cell phone companies, ISPs, etc. I just thought the Circuit court decision was very interesting.

Honestly if Pystar is able to make cheap Macs, it will hurt Apple as the luster and uniqueness of their machines will not there anymore. I can understand why Apple would be against it, but so far Apple has been hands off.

Apple has the right to only support their OS on their own hardware, don't they?

If the courts tell Apple they can't make their software Apple hardware-only anymore, they can just simply lift the restriction and then tell 3rd parties, "There, you're on your own now," can't they?

True, they could. But IMO it would give Apple a black eye in the public relations department (which right now they are flying very high). It would be a double edged sword for them.

Apple still hasn't said anything. The publicity is entirely from blogs

Absolutely. If Psystar is a success the machines they sell will almost certainly come with no official apple support
