The BIOS & EFI emulation would not be a factor, it only applies during boot up, not once the OS is loaded. Also, it IS illegal PERIOD, the EULA for OS X clearly states that it can only be installed on genuine Apple hardware, so even if you own a legitimate license for OS X, you cannot install it on non-Apple hardware.

They must have changed it recently then. It used to say that it must be (direct quote) an "Apple labeled" computer. So the whole argument was that you could slap a sticker on your PC and call it a day. Obviously its a bad argument but you know how technical the law can be.

The apple EULA, concerning OSX being installed on Apple hardware is against Antitrust Laws, as a 1984 U.S. Circuit Court of Appeals decision states

"a software publisher can't require you to run an operating system on a specific type of hardware."

The Supreme Court refused to review the case. source

sorry but thats a very long read, which part exactly are you referring to?

I brought my copy of OSX legally so what part of that list am i suppose to be breaking?

I also see that psystar.com have already sold several open computers with OSX preload and apple haven't done a thing about it ... maybe apple is scared of opening a can of worms?
